What is the time limit to
contest a Will?

The time limit to contest a will varies depending on the nature of the claim. For claims under the Inheritance (Provision for Family and Dependants) Act 1975, the claim must be made within six months from the date of the grant of probate or letters of administration. However, there is no fixed time limit to challenge the validity of a will itself. It’s advisable to act promptly, as delays can complicate proceedings and may affect the outcome.

Who can contest
a Will?

Only certain people have the right to contest a will. This typically includes spouses, children, and other dependants who were financially supported by the deceased, as well as individuals who would have inherited under a previous will or under intestacy laws. Claimants must demonstrate a legitimate interest in the estate for the court to consider their challenge.

What are the grounds for
contesting a Will?

A will can be contested on several grounds. This may include situations where the person making the will lacked the mental capacity to understand what they were doing, or where they were subject to undue influence or pressure from others. A will may also be challenged if the deceased did not understand or approve its contents, or if it was not signed and witnessed correctly.

In addition, claims can be brought under the Inheritance Act where someone who was financially dependent on the deceased has been left out of the will or not reasonably provided for. This can include spouses, former spouses, children, and stepchildren. Each case is considered on its own facts, and legal advice is essential.
